Condo association dropped from lawsuit over parking ramp mishap

May 25, 2011 – As the lawsuit against owners of Marina City drags on – over an accident on commercial property in 2009 – the condo association at Marina City, at least, is no longer a defendant.

According to court records, Marina Towers Condominium Association was voluntarily dismissed on March 11 from a lawsuit filed last year by a security officer for the commercial property at Marina City.

Marina City is a “mixed use” complex, with the owner of Hotel Sax owning the commercial property and the condo association representing owners of the residential property.

On May 17, 2009, at about 1 p.m., as she tried to stop a bus from entering the complex, Tara Collins says she was injured when she tripped over a low-hanging chain near the entrance ramp from State Street. She filed a lawsuit on February 10, 2010, seeking $50,000 from LaSalle Hotel Properties, Marina Towers Condominium Association, System Parking, and the commercial property manager, Transwestern.

An attorney for Collins, Ari Kirshner, confirmed on Wednesday the dismissal of the condo association, saying, “Information provided indicated that they were not responsible for the area in question.”

According to Kirshner, the lawsuit is still in its pre-trial discovery phase, in which both parties obtain evidence from each other.
