Kimmel sentencing rescheduled

  • November 20 date granted over objection of Assistant U.S. Attorney
  • Kimmel attorney will seek sentence below minimum guidelines

September 25, 2008 – Sentencing for Gary Kimmel has been rescheduled to November 20. His attorney, Joseph Lopez, filed a motion on September 19 to reset the sentencing date, which had been scheduled for today. Lopez says he needs more time to prepare a Motion for Downward Departure, which will seek a sentence that is below minimum guidelines.

The Marina City resident pleaded guilty on May 29 to federal charges of money laundering related to a nationwide prostitution ring.

A presentence report was received by the court on September 9 but it is not made public. Preliminary sentencing guidelines called for 37 to 46 months in prison, followed by three years of supervised release.

Neither Kimmel or Lopez was present at the brief hearing late Thursday morning. Gerardo Gutierrez filled in for Lopez. Kimmel is on pretrial release. According to court documents, he was released on his own recognizance on January 26, 2006.

With his dentist license suspended since June 2006, Kimmel currently works as a bank courier for Mahoney Express Inc., a trucking company based in Forrest Park.
